AUCTION OPENS 10/15/2021 at 12Pm and CLOSES on 10/26/2021 at 12Pm. Survey to be split equally between both buyer and seller 50/50. Sales price will be based on actual surveyed acres. Any and all bids are on a PER ACRE basis. See Attached map for tracts.

Bidding ends on October 26, 2021 @ 12:00PM

BUYERS PREMIUM: 5% Buyer’s Premium will be added to the final bid price to arrive at the contract sales price.

ACCEPTANCE OF BID PRICES: Winning bidder will enter into a Contract to Purchase immediately upon being declared the Successful Bidder by the Auctioneer. Upon the close of the auction, the winning bidder will be forwarded via email a Contract to Purchase. Living The Dream must receive a signed copy of the contract on or before Auction close date. (hand delivered, faxed, or scanned and emailed). The Seller reserves the right to reject any and all bids. Once accepted, this agreement shall be binding on the parties and their successors and assigns. This agreement is NOT subject to financing, inspections, or other contingencies or delays the closing for such reason.

DOWN PAYMENT: Non-Refundable deposit of 10% of the contract purchase price will be due upon acceptance of the Sales Contract. Business or Personal Checks or Wire Transfer are accepted.

CLOSING: Closing shall be on or before 45 days from close of Auction

POSSESSION: Possession will be given at closing, subject to the remaining rights of the current tenant if any.

TITLE: Seller shall furnish the buyer(s) at Seller’s expense an Owner’s Policy of Title Insurance in the amount of the purchase price and agrees to provide and execute a proper deed conveying merchantable title to the real estate to the buyer(s).

SURVEY: Tracts are selling on a PER ACRE basis and will be adjusted on actual surveyed acreage. Survey cost to be split equally between buyer and seller at closing.

REAL ESTATE TAXES: The Real Estate taxes to be paid for current year will be prorated at closing.

Under no circumstances shall Bidder have any kind of claim against Living The Dream INC, or anyone else if the Internet service fails to work correctly before or during the auction.

The online auction platform allows for a “soft auction close” and… – If a lot receives a bid within the last 10 min. it will remain open for an additional 10 min. – If any further bidding occurs, the extension timer will reset to 10 min. – If no further bidding activity occurs, the lot closes when the timer runs out.

All announcements the week of the sale take precedence over any pre-printed material.

Proof of funds, a bank letter of guarantee, or financing approval on bank letterhead MUST be emailed to heatherlivingthedream@gmail.com before you will be approved to bid.

Bidding platform records of Auction Co. will be deemed conclusive in all respects and will be final. In the event of two identical absentee bids, the first bid received will be the successful bid.
